Donald Trump administration arms officials to reject H-1B applications The Donald Trump administration has tightened visa rules even further with his latest policy issued on July 13. According to this policy, the US administration has given power to the officials to reject a visa application if the applicant fails to establish eligibility for the visa. The new rule will be applicable will go into effect from September 11 onwards. According to the new rules, the visa applicant is unlikely to get a second chance to submit more documentary evidence to support their eligibility if their application is rejected in the first place. Previously, officials were not rejecting an application entirely and used to give an opportunity to provide more documentary evidence to support their eligibility. An H-1B holder could also face deportation in some cases like if the plea for the visa extension or change of status has been rejected at first place. Also in case, the original term of stay sanctioned by the US administration in your Form 1-94 has expired. The US Citizenship and Immigration Services (USCIS) latest policy also states that it can issue 'notice to appear' (NTA) in cases “whereupon denial of an application or petition, the applicant is ‘unlawfully present’ in the US.” It means that, if you no longer have a job, the applicant still has to stay in the US, until and unless he has heard by an immigration judge. The only purpose of the NTA is to place an individual in deportation proceedings. If the applicant has served NTA, then he has to stay in the US and have to appear before an Immigration Judge. if an applicant didn’t appear, he may face a five-year ban on re-entry to the US. The revised policy gives subjective powers to officials and could make the immigration process more complex and complicated for applicants. As the Donald Trump aims at the H-1B visas, they have reduced their applicants. Tightening of H-1B work visa norms has increased operating costs of Indian IT companies as onsite hiring has increased.-
