Delhi court on Thursday put a stay on the execution of the four convicts in the Nirbhaya rape case over a mercy petition filed by one of the convicts Mukesh Singh. Delhi Court directed Tihar jail authorities to file proper report by Jan 17 about status of scheduled execution of convicts. Directions passed after jail authorities informed, they wrote to Delhi govt on issue of scheduled execution in view of pending remedies.
The Tis Hazari Court Judge said that “I am not reviewing my order to pass a death warrant. There will be a stay on the execution of the death warrant since a mercy plea is there.” Meanwhile, the Judge added that “Jail authorities just have to give me the report saying we will not hang them on January 22.”
On Wednesday, the Delhi government said that the four convicts cannot be hanged on January 22 as there is still a mercy petition filed by Mukesh Singh, one of the four convicts. All the four convicts — Mukesh (32) Vinay Sharma (26), Akshay Kumar Singh (31) and Pawan Gupta (25) – were to be hanged on January 22 at 7 am in Tihar jail. Delhi court had issued the death warrants on January 7.
On Thursday, Delhi government rejected the mercy plea of 2012 Delhi gang-rape case convict Mukesh Singh. Also, Ministry of Home Affairs source was quoted by ANI as saying, “Home Ministry has received mercy petition of 2012 Delhi Nirbhaya gang-rape case convict Mukesh Singh from Delhi government and it is under process.”
