Badlapur Assault Case: FIR filed against school under POCSO Act | IN POINTS

Badlapur Assault Case: A case has been filed against the Badlapur school under various provisions of the Protection of Children from Sexual Offences (Pocso) Act for failing to report the sexual assault of two nursery students to the police. The case has been filed by the Special Investigation Team established to probe the case of abuse of two 4-year-old girls at a school in Badlapur. 

According to an earlier First Information Report (FIR) on the matter, the assaults took place in the school bathroom on August 13, and the parents contacted the police on August 16. They said that the FIR was lodged 11 hours following their complaint. The alleged cleaning staff member, Akshay Shinde, 23, was detained on August 17, and the principal, a class teacher, and a woman attendant have all been suspended by the school management.


Badlapur Assault Case Update | In Points

  • The SIT has filed a case under Section 21 of the Pocso Act, which states that anyone who gets knowledge of a sexual offence involving a child must report it to the police.
  • For several days, common people in the city, as well as members of the state's opposition party, have been demanding action against the school administration.
  • The latest development came after a Bombay High Court judge expressed surprise on Thursday while taking suo moto cognisance of the case, that despite complaints from the victims, no immediate action was taken against the school under the Protection of Children from Sexual Offences (Pocso) Act, which requires strict legal proceedings against authorities who fail to report such crimes. Furthermore, the HC observed that parents had to wait 11 hours to file a case with the police.
  • Meanwhile, Shiv Sena (UBT) chief Uddhav Thackeray on Friday demanded the withdrawal of the cases against those who had protested in Badlapur against the incident.
