Bareilly Court Declares Instant Triple Talaq Given to Nida Khan as Invalid
Bareilly Court declared the instant triple talaq given to Nida Khan by his husband as Invalid. Also, the court has rejected the petition filed by her husband who had sought a stay on the domestic violence case filed against him by Nida Khan. Court has given the next hearing date of July 27 in the matter while rejecting Khan’s husband Sheeren’s petition in this hearing.
The court also ordered the investigation in the domestic violence case against Sheeren and his family for torturing Khan. Nida Khan approached the Supreme Court and challenged the triple talaq given by her husband. And that is why; Nida Khan’s case grabbed the nation’s attention.
She told that she was forced to sleep consummate marriage with her brother-in-law and father-in-law under the Islamic practice of ‘Nikah Halala’. According to this law, she has to consummate a marriage with other men and divorce him before re-marrying her own husband. She also asked Uttar Pradesh Chief Minister Yogi Adityanath to abolish the ‘evil’ practice to dissolve marriages solemnised as per the Sharia law.
The Centre also introduced a law under which Muslim men could be jailed for up to ten years who give instant divorce to their wives.
And last summer, Supreme Court banned instant divorce and tagged it as “unconstitutional”. They also made a law under which Muslim Men could be jailed for up to ten years who give instant triple talaq to their wives.
The Issue is in the limelight again as the Apex Court is all set to give its opinion on “Nikah halal”. Khan’s campaigning against the practices has seen Muslim clerics issuing fatwas calling for her boycott.
Shahar Imam Mufti Khurshid Alam of Bareilly Jama Masjid had said, “No medicines will be provided if she falls ill. If she dies, no one is allowed to offer namaz on her ‘janaza’ (funeral procession). She cannot be buried in kabristan (graveyard) after her death.” He also said, “Nida wants an amendment in Sharia while Islamic laws were made by Allah. As Nida has been making statements against Quran and Hadith, she is dismissed from Islam.”
