New Delhi, March 16: The Supreme Court announced on Wednesday that it would consider pleas challenging the Karnataka High Court's verdict on the Hijab ban at educational institutions after the Holi break. After senior advocate Sanjay Hegde appeared for petitioners sought an urgent hearing, a bench comprising Chief Justice of India NV Ramana, Justices AS Bopanna and Hima Kohli said it would consider listing the matters after the Holi vacation. "The urgency is this that there are several girls who have to attend colleges. List this on Monday," said advocate Hegde, to which CJI responded by saying, "Others have mentioned too. We will see, we will post the matter. Let us see we will post the matter after Holi vacations." Some of the petitioners in the High Court have appealed to the Supreme Court, challenging the verdict upholding the Karnataka government's order requiring strict adherence to uniform rules in schools and colleges.

The plea further argues that the High Court in its impugned order "had vehemently failed to apply its mind and was unable to understand the gravity of the situation as well as the core aspect of the Essential Religious Practices enshrined under Article 25 of the Constitution of India". SC to list hearing over Karnataka HC's Hijab Verdict On Tuesday, a Karnataka High Court bench comprising of Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit and Justice JM Khazi held that the requirement of uniform is a reasonable restriction to which students cannot object, and dismissed various petitions challenging the ban on hijab in educational institutions, saying they are without merit. The hijab protests in Karnataka began in January 2022 when some students of Government Girls PU college in the Udupi district of the state were allegedly barred from attending classes. Some students, during the protests, also claimed they were denied entry into the college for wearing hijab. They stated that the hijab is protected under the Constitution's religious freedoms and that no college development body is equipped to determine whether it can be banned due to public order violations. Following this incident, students from many colleges donned saffron stoles to Shanteshwar Education Trust in Vijayapura. Several colleges in the Udupi district were in the same boat. SC to list hearing over Karnataka HC's Hijab Verdict As a result, the Karnataka government mandated that all students wear the uniform and banned hijab and saffron scarves until the issue was resolved by an expert committee. The pre-university education board issued a circular on February 5 declaring that students could only wear the school's approved uniform and that no other religious clothing would be permitted in colleges. The decree noted that if management committees do not mandate a uniform, students should dress in a manner that promotes equality and unity while not disrupting the social order.
