SC asks Madras HC to take final decision on TikTok on April 24 or no Ban

The Supreme Court on Monday directed the Madras High Court to take a decision on TikTok plea for lifting its ban failing which the interim injunction would be vacated. A bench headed by Chief Justice Ranjan Gogoi has directed to take a final decision in the matter on April 24.

The Supreme Court earlier rejected the plea to stay the Madras High Court order to ban the TikTok app over pornographic content concern. Senior advocate, Abhishek Manu Singhvi, appearing for the Chinese company ByteDance, told the media reports that Madras High Court passed the order without listening to their side. He further said that the court didn’t even issue a notice in the matter.

The Madras high court on April 3 asked the central government to ban popular Chinese video application TikTok citing that it was “encouraging pornography”.

A Madurai-based senior lawyer-cum-social activist, Muthu Kumar, filed a petition at the Madras High court that said that children who use TikTok were more exposed to the sexual predators. He cited pornography, cultural degradation, suicides, and child abuses as his reasons to ban the app. He had requested the court to direct a ban on the application.

Following this, the central government sent a letter to Apple and Google to abide by the state court’s order. After this, the app is no longer available on Apple and Google platforms in India.

TikTok, which allows users to create and share short videos with special effects, has become hugely popular in India but has been criticised by some politicians who say its content is inappropriate.

The state court has requested written submissions from Bytedance in the case and has scheduled its next hearing for April 24.
