Delhi Excise Policy Case: The Delhi High Court is set to announce its decision on Tuesday regarding a plea filed by Arvind Kejriwal, challenging his arrest by the Enforcement Directorate in the Excise Policy money laundering case. Justice Swarna Kanta Sharma's bench has scheduled the order's pronouncement for Tuesday at 2:30 pm.

Last week, after hearing extensive arguments from both sides, the bench had reserved its decision on the matter. Kejriwal, the Chief Minister of Delhi, has contested both his arrest and the remand granted by the trial court.

Senior advocate Abhishek Manu Singhvi, representing Kejriwal, argued that the timing of the arrest raises concerns about democracy and a level playing field. Singhvi contended that the arrest lacked any substantial basis and appeared to be aimed at humiliating and disabling the petitioner. He emphasised the absence of sufficient grounds for arrest after over a year of investigation.

On the other hand, the Enforcement Directorate, opposing Kejriwal's plea, asserted that the investigation is still in its early stages and Kejriwal's cooperation is vital. The agency highlighted Kejriwal's refusal to comply with multiple summons and accused him of deliberately evading the investigation.

In its reply submitted to the Delhi High Court, the Enforcement Directorate defended Kejriwal's arrest, stating it was conducted in strict adherence to the law. The agency alleged that the Aam Aadmi Party (AAP) benefited significantly from proceeds of crime in the Delhi Liquor Scam and accused Kejriwal of involvement in money laundering.

The case stems from alleged irregularities and money laundering related to the Delhi Excise Policy 2022. While Kejriwal was not initially named in the FIRs, the ED's chargesheet implicated him, alleging his direct involvement in the formation of the excise policy.

The trial court had previously remanded Kejriwal to judicial custody till April 15, 2024. The case has garnered significant attention, as it intersects with political dynamics and concerns about the integrity of electoral processes. Kejriwal's plea seeks to challenge the legality of his arrest and the grounds on which it was carried out.
