Swati Maliwal assault case: Bibhav Kumar transported to Mumbai for iPhone data retrieval

PTC News Desk: The five-member special investigation team (SIT) of the Delhi Police is transporting Bibhav Kumar, an adviser to chief minister Arvind Kejriwal, to Mumbai in order to retrieve data from his formatted iPhone. Kumar was detained on suspicion of assaulting Rajya Sabha MP for the Aam Aadmi Party (AAP), Swati Maliwal.

The authorities claim that Bibhav Kumar formatted his phone before sending the information to a person or gadget in Mumbai.

Two days after a case was filed against him under sections 308 (attempt to commit culpable homicide), 341 (wrongful restraint), 354 (B) (assault or use of criminal force to a woman with intent to disrobe), 506 (criminal intimidation), and 509 (word, gesture, or act intended to insult the modesty of a woman) of the Indian Penal Code, Bibhav Kumar was taken into custody on Saturday from Kejriwal's home.

He is currently under judicial custody for five days.

What was said in Swati Maliwal's complaint?

In her complaint, the former DCW chief said that on May 13, when she went to meet with Kejriwal, she was attacked by Kumar at the chief minister's official residence. She claimed that Kumar repeatedly kicked and smacked her in the pelvic and abdominal regions. In addition, she said that Bibhav purposefully tugged her top.

The police then filed a complaint against Kumar as a result.

Maliwal was brought to Kejriwal's home by the Delhi police team on Friday in order to reconstruct the murder scene. They took the DVR from the CCTV cameras during this period, and they also recorded her statement in front of the magistrate.

Shortly prior to his apprehension, Kumar sent an email to the Delhi police refuting Maliwal's claims, asserting that she had mistreated him with the intention of assault.

"The undersigned has learned via the media that P.S. Civil Lines has filed a case F.I.R. No. 27/2024 in which the undersigned is listed as an accused party. It should be noted that the undersigned has also filed a complaint, exposing the actual details of the said event that occurred on May 13, 2024, by email correspondence dated May 17, 2024, at 3:34 p.m., sent to the following email addresses: dep.north@delhipolice.gov.in and sho-civilline-dl@nic.in. It is asked that the matter be documented and looked into in compliance with the law.
