Canadian mother moves Punjab and Haryana HC after Indian husband disappears with son

PTC Web Desk: A Canadian mother has approached the Punjab and Haryana High Court seeking justice after her estranged husband, an Indian-origin man related to former UK Prime Minister Rishi Sunak, disappeared with their four-year-old son.

The woman, originally from Brazil and now residing in Canada, married Kapil Sunak, an Indian-origin man, in Canada. The couple later had a son. However, their relationship deteriorated, leading to separation. Amid the separation, Kapil Sunak took their son without consent in Canada, but the Canadian court had granted interim custody of the child to the mother.


Despite the court's custody order, Kapil Sunak travelled to India, prompting the Canadian authorities to require that he provide full details of his stay in India, including his address and host details. He was given a three-week window for this disclosure. However, after reaching India, Kapil neither informed the authorities nor returned to Canada as mandated.

In December 2024, the Canadian court issued a final judgment awarding full custody of the child to the mother. Following this, the distraught mother travelled to India in search of her son and filed a petition in the Punjab and Haryana High Court.

While the High Court ruled in favour of the mother on April 22, ordering that custody of the child be handed over to her, it was too late — Kapil Sunak had already disappeared with the child before the judgment could be enforced. His visa had also expired during this time.

Now, the mother, devastated and desperate, is preparing to file a contempt petition against her husband in the High Court for violating the court’s custody orders. She seeks urgent intervention to locate and reunite with her missing son.
