Vague, can be misused: Supreme Court stays UGC Promotion of Equity Regulations 2026

The Supreme Court observed that the new guidelines could potentially create social divisions and have serious societal consequences, warranting judicial intervention.

PTC News Desk: The Supreme Court on Thursday put a temporary halt on the implementation of the University Grants Commission’s (UGC) newly introduced anti-discrimination regulations, citing concerns over their vague wording and possible misuse. The court issued notices to both the central government and the UGC, directing that the new rules remain suspended until further orders.


Earlier this month, the UGC had rolled out the regulations requiring all higher education institutions to establish equity committees tasked with addressing discrimination complaints and promoting inclusivity. These committees were mandated to include representatives from Other Backward Classes (OBCs), Scheduled Castes (SCs), Scheduled Tribes (STs), persons with disabilities, and women. The move sparked protests among students across multiple states, with opponents arguing that the rules could be exploited.


The Supreme Court observed that the new guidelines could potentially create social divisions and have serious societal consequences, warranting judicial intervention. It clarified that the 2012 guidelines, which were advisory rather than mandatory, will continue to remain in effect. The bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi reiterated that the court’s involvement was necessary given the far-reaching and potentially harmful implications of the new regulations.



"If we don't intervene it will lead to a dangerous impact, will divide society and will have a grave impact," the Chief Justice said, adding, "Prima facie we say that the language of the regulation is vague and experts need to look into for the language be modulated so that it is not exploited".
