Big relief for Gandhis: Court throws out ED's chargesheet against Sonia, Rahul Gandhi in National Herald Case
PTC News Desk: In a major relief to Sonia Gandhi and Rahul Gandhi in the National herald case, a Delhi Court on Tuesday dismissed the Enforcement Directorate's money laundering complaint against Congress leaders Rahul Gandhi and Sonia Gandhi in the National Herald case.
Special Judge (PC Act) Vishal Gogne of the Rouse Avenue Court said the observed that the prosecution was legally unsustainable at this stage as the case was registered based on a personal complaint and nor First Information Report (FIR)
Besides Gandhis, Suman Dubey, Sam Pitroda, Young Indian, Dotex Merchandise and Sunil Bhandari were also made accused by the Enforcement Directorate (ED).
The judge noted that the case arose from a private complaint filed by BJP leader Subramanian Swamy before a magistrate and not from an FIR relating to a scheduled offence under the PMLA.
Meanwhile Congress had maintained that ED's case has been stemmed from political vendetta with the agency refuting allegations and asserted erious economic offence including orgery and money laundering.
The ED has alleged that properties of Associated Journals Limited, valued at over 2,000 crore, were wrongly taken over.
Reacting to the development in a post on X, the Indian National Congress has reacted saying ‘Truth has triumphed.’
It further stated that “The malicious and illegal actions of the Modi government have been completely exposed. The Hon'ble Court has found the ED's actions against the Congress leadership—Smt. Sonia Gandhi ji and Shri Rahul Gandhi ji—in the Young Indian case to be unlawful and motivated by malice. The court has ruled that the ED's case is beyond its jurisdiction, as it lacks any FIR, without which no case can even be made.
