Chandigarh mayor elections: AAP councillor moves SC after High Court refuses immediate stay

Chandigarh mayor elections: An Aam Aaadmi Party(AAP) councillor Kuldeep Kumar moved the Supreme Court on Thursday, challenging the Punjab and Haryana High Court's refusal to stay the Chandigarh Mayor elections.

AAP councillor Kuldeep Kumar filed a Special Leave Petition, citing the High Court's decision to list the matter after three weeks without providing an immediate stay of the results.


He filed a High Court petition alleging vote tampering in the Chandigarh Mayor Elections, in which Bharatiya Janata Party (BJP) candidate Manoj Sonkar was declared the winner on Tuesday. The BJP candidate received 16 votes, while Kuldeep Kumar, who was supported by the Congress and AAP, received only 12 votes as the Presiding Officer declared 8 votes invalid.

He requested that the impugned election results be set aside "as the same is the result of complete fraud and forgery laid upon the democratic process" and that new elections be held in a free and fair manner under the supervision of a retired High Court Judge.

Yesterday, the High Court denied his request to halt the operation of the office until further orders. "Whether counting was proper, whether procedure was followed or not…These are all questions of facts," it stated.
