NHRC seeks report from Punjab government over non-observance of Independence Day in rural, border area schools
PTC News Desk: The National Human Rights Commission (NHRC) has sought a detailed report from the Punjab government over allegations of not holding Independence Day celebrations at some government schools in rural remote border areas of the state.
The NHRC took cognisance of a complaint alleging lack of participation by the students in activities such as flag-hoisting, the National Anthem and programmes related to the freedom struggle, constitutional values, fundamental duties and national responsibilities.
The commission directed the Secretary, Department of School Education and Literacy, Ministry of Education; the Secretary, Ministry of Home Affairs; and the Chief Secretary of Punjab to submit a response on the same.
The Commission, however, clarified that the manner in which an individual school conducts an Independence Day programme cannot by itself be treated as a human rights violation.
The NHRC said the allegations raise concerns over whether children studying in rural, remote and border areas receive the same opportunities to take part in educational and co-curricular activities as students in urban and better-equipped schools.
The Commission said the matter needs to be examined to determine whether there is a pattern of administrative neglect, failure to follow government instructions, or systematic denial of educational and civic opportunities due to geographical or socio-economic conditions.
The NHRC referred to Article 14 of the Constitution, which guarantees equality before the law, and Article 21A, which provides children with the right to free and compulsory education within the prescribed age group.
It also mentioned Article 51A, which outlines citizens’ fundamental duties, including respecting the Constitution and national institutions and cherishing the ideals of India’s freedom struggle.
According to the Commission, celebrating national festivals and promoting patriotism and respect for national symbols are important parts of a child’s educational experience. However, it said such activities should be part of a broader environment that supports the academic, physical, emotional, social, cultural and creative development of children.
The NHRC has asked authorities to clarify whether the Independence Day 2026 instructions were communicated to all government schools in Punjab and whether they were implemented equally across the state.
