Serving in Op Sindoor won't give immunity: Supreme Court to commando accused of killing wife
PTC News Desk: The Supreme Court on Tuesday reprimanded a Black Cat Commando who in his plea sought exemption saying that he served in Operation Sindoor.
“I can only leave with one line, I am a participant of Operation Sindoor. For the past 20 years I am a black cat commando posted my lord in Rashtriya Rifles,” the plea stated.
The bench was hearing a plea in which the commando sought exemption from the surrender before the police on the pretext of serving in Operation Sindoor. When the Commando mentioned that he was part of Operation Sindoor, India's counterstrike to avenge the Pahalgam Terror Attack, the court replied sternly that it "does not give you immunity".
Justice Ujjal Bhuyan responded to the Commando's argument, "That doesn't give you immunity. How physically fit you are, you alone could have strangulated your wife."
The bench of Justice Ujjal Bhuyan and Justice Vinod Chandran, while hearing a special leave petition filed against a Punjab and Haryana High Court order, highlighted serious offence. The Punjab and Haryana High Court order had dismissed the convict's appeal and upheld the sentence of rigorous imprisonment of 10 years.
The commando's counsel argued that the only allegation against him is that he demanded a bike in dowry, a charge made by two witnesses closely related to his late wife.
The court, however, refused to grant relief. It issued a notice, seeking a response from the prosecution on the Special Leave Petition. "We decline the prayer for exemption from surrendering. Issue notice on the SLP returnable in six weeks."
