The bench led by CJI overturned Calcutta High Court's decision to order a CBI investigation while pointing out that the courts are barred from investigating cabinet decisions and that the order was incorrect.

Supreme Court sets aside high court's order directing CBI inquiry into additional posts for teachers in Bengal

PTC News Desk: In a significant relief to Mamata Banerjee government, the Supreme Court said that no CBI inquiry will be conducted into the Bengal government's creation of extra posts to accommodate the estimated 25,000 teaching and non-teaching staff sacked from the state's School Service Commission after the court voided the selection process.


The bench led by CJI overturned Calcutta High Court's decision to order a CBI investigation while pointing out that the courts are barred from investigating cabinet decisions and that the order was incorrect.

The bench also observed that the additional posts were created only after the required consultations and Governor's approval and do not require any judicial intervention.

However the high court in the same matter deemd the creation of posts as 'illegal'. The court also directed the central agency to take into custody the cabinet ministers and summon them for questioning.

After the Supreme Court paused the High Court's order allowing a CBI probe, it finally dismissed the directive today
