Bills to remove PM, chief ministers arrested on serious charges for over 30 days, to be tabled today
PTC News Desk: A bill aimed at removing elected representatives arrested or detained on serious criminal charges from office will be introduced in Parliament on Wednesday. The legislation will apply to the Prime Minister, Union ministers, Chief Ministers, and ministers of Union Territories.
Along with this, three other bills — the Government of Union Territories (Amendment) Bill 2025, the Constitution (One Hundred and Thirtieth Amendment) Bill 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill 2025 — may also be referred to a parliamentary committee. Union Home Minister Amit Shah is expected to move the motion in the Lok Sabha.
Currently, under the Constitution, public representatives can only be removed after conviction. Since the new proposal seeks to alter this provision, it will require constitutional amendments to Articles 75, 164, and 239AA.
As per the bill, if a Prime Minister, Union minister, Chief Minister, or a minister from a state or Union Territory is arrested and remains in custody for 30 consecutive days, they must resign by the 31st day, failing which they will be automatically removed from office.
