The case stems from a complaint filed by Kolkata resident Tushar Kanti Das, who alleged that Banerjee's speech could promote communal disharmony and disturb public order. The complaint was lodged at the Hare Street Police Station and has now been registered as an FIR by Kolkata Police.
According to the complaint, submitted earlier at the Netaji Nagar Police Station on May 20, Banerjee made remarks during a public meeting ahead of the 2026 West Bengal Assembly election campaign that could create fear, misunderstanding and tension among different communities in the state.
The complainant alleged that while warning voters against what she described as the Bharatiya Janata Party's "misleading publicity," Banerjee suggested that if voting patterns changed, a particular community could face adverse consequences. He claimed the statement was vague and open to interpretation, potentially creating apprehension and a sense of insecurity among citizens.
The complaint sought legal action against the Trinamool Congress leader, alleging that her remarks were inflammatory and had the potential to disturb communal harmony. Police have registered the FIR and are expected to investigate the allegations. No official response from Banerjee or the All India Trinamool Congress had been reported in connection with the FIR at the time of filing.
