Centre initiates process to appoint new CJI, Justice Surya Kant likely to succeed
PTC News Desk: The central government on Thursday began the process of appointing the next Chief Justice of India, as the incumbent, Justice B.R. Gavai, is set to retire on November 23, sources said.
The formal letter requesting Justice Gavai to recommend his successor is expected to be sent either Thursday evening or Friday, according to officials familiar with the judicial appointment process.
As per the Memorandum of Procedure, which governs the appointment, transfer, and elevation of judges in the Supreme Court and High Courts, the Chief Justice of India is traditionally chosen from among the senior-most judges of the Supreme Court deemed fit for the role.
The Union Law Minister, at the appropriate time, seeks the recommendation of the outgoing CJI for his successor — typically about a month before the incumbent turns 65 and retires.
Justice Surya Kant, currently the senior-most judge after the CJI, is next in line to head the Indian judiciary. If appointed, he will assume office as the next Chief Justice of India on November 24 and is expected to serve until February 9, 2027 — a tenure of nearly 15 months.
