Disproportionate assets case: SC rejects plea on closure of CBI inquiry against Mulayam Singh Yadav, kin

New Delhi, March 13: Supreme Court on Monday refused to hear a plea seeking the closure of preliminary inquiry by the CBI in 2013 into the alleged acquisition of disproportionate assets by late former Uttar Pradesh Chief Minister Mulayam Singh Yadav and his son Akhilesh Yadav.

The petition was dismissed by a bench led by Chief Justice of India DY Chandrachud. In light of the directions issued by the Supreme Court in its judgements of March 1, 2007 and December 13, 2012, petitioner Vishwanath Chaturvedi has approached the Supreme Court seeking a direction to the CBI to place the investigation report of the case before the top court or a jurisdictional magistrate.

The top court noted on Monday that the top court's judgements were from 2007 and 2012, and the CBI closed the investigation on August 7, 2013 and submitted a report to the CVC in 2013. The court also noted that the plea was filed in 2019, six years after the CBI's report was submitted to the CVC.

The court dismissed the petition because it lacked merit.

The petitioner argued in the plea that the matter has already been delayed inordinately and unnecessarily and that the unusual delay in filing regular case against the offenders has not only caused some irreparable and irrecoverable damage to the entire case but has also raised serious questions about the credibility and integrity of our investigating agencies.

According to the petitioner, the respondent CBI has yet to inform the petitioner of the status of the case, nor the filing of any final report, either before the jurisdictional magistrate or to the top court, despite the directions issued in the two judgements in 2007 and 2012.
