Man cites 'live-in relationship agreement' to get pre-arrest bail in assault case
PTC News Desk: To secure pre-arrest bail in a sexual assault case filed by his live-in partner in Mumbai, a 46-year-old man produced a "live-in relationship agreement" in which he claims they agreed not to file any sexual harassment cases against each other.
On August 29, the court granted him bail in the rape case.
However, the 29-year-old woman who took him to court told a Mumbai court that the signature on the document was not hers.
The woman works as an elderly caregiver while the accused is a government official, according to the police, who are now investigating the alleged relationship pact.
The woman said that her partner promised to marry her and raped her several times while they were living together.
The lawyer representing the accused has described the case as fraud.
"The applicant has been falsely implicated in the case. He is a victim of circumstances. They were in a live-in relationship. The agreement shows that both of them had agreed to be in a relationship. The agreement was made, and the woman signed it. The agreement shows that both of them had agreed to be in a relationship," said Sunil Pandey.
According to the seven-point agreement, the two will stay together from August 1, 2024, to June 30, 2025. The second provision specifies that during this time, they will not file any sexual harassment complaints against each other and will spend their time together peacefully.
The woman will live with the man at his home, according to the third clause, and if she considers his behaviour unsuitable, she can leave at any moment with one month's notice.
The fourth clause states that the woman's relatives cannot visit her at home while she is residing with him.
According to the sixth clause, the woman should not harass or cause mental agony to the man.
The sixth clause states that if the woman becomes pregnant during this time, the man should not be held responsible. The eighth clause specifies that if the harassment causes mental stress to the man, destroying his life, the woman will be held accountable.
