Allahabad high court upholds trial court's order directing mosque survey, rejects mosque panel's plea

Proceedings at the trial court level were stayed by the Supreme Court, with a directive that no further action be taken until the High Court addressed the mosque committee's petition against the survey order.

Allahabad high court upholds trial court's order directing mosque survey, rejects mosque panel's plea

PTC News Desk: The Allahabad high court on Monday rejected Mosque panel's petition challenging trial court's November 2024 order directing an Advocate Commissioner to survey the mosque in a suit which claimed that the mosque was built after destroying a temple.


Proceedings at the trial court level were stayed by the Supreme Court, with a directive that no further action be taken until the High Court addressed the mosque committee's petition against the survey order.

With this, a bench of Justice Rohit Ranjan Agarwal has upheld the trial court's survey order. It also added that the Hindu Plaintiffs is prima facie not barred.

The Trial Court's order was passed on a suit filed by eight plaintiffs, including Mahant Rishiraj Giri, who claimed that the Sambhal Mosque was built in 1526 after demolishing a Hindu temple that stood there.

The mosque committee has filed a petition seeking a stay on the ongoing trial court proceedings  in an original suit pending before the district court in Sambhal. It is in the plea argued that the order for the survey was passed hastily and without issuing a prior notice. It was further argued that the survey of mosque was conducted twice, once on the same day as the order and again on November 24, the day the violence erupted.

The violence erupted in Sambhal in November 2024 when a mob clashed with police and objected the Advocate Commission team which had arrived to survey the 500-year-old mosque
