PM Modi Degree Case: Gujarat HC rejects Arvind Kejriwal's plea to quash summons

PM Modi Degree Case: The Gujarat High Court on Friday rejected Aam Aadmi Party leaders Arvind Kejriwal and Sanjay Singh's plea to quash the summons issued against them in a criminal defamation case over their comments about Prime Minister Narendra Modi's educational qualifications.

Delhi Chief Minister Kejriwal and AAP Rajya Sabha member Singh challenged the summons issued by a trial court in the Gujarat University case, as well as the subsequent order of the sessions court dismissing their revision applications.


Justice Hasmukh Suthar rejected their applications and directed the two AAP leaders to make their submissions to the trial court.

Seeking to quash the summons, the two leaders stated that Gujarat University (GU) cannot file a defamation case before a magistrate court and must instead proceed to the sessions court.

On April 15, last year, the metropolitan court summoned Kejriwal and Singh in a defamation case filed by GU regarding their "sarcastic" and "derogatory" statements about PM Modi's degree.

The two leaders then filed a revision application with the sessions court, challenging the summons.

However, the sessions court upheld the summons, and they then approached the Gujarat High Court, which denied their request for an interim stay.

The two leaders also approached the Supreme Court, which declined to hear their pleas.

The HC later directed the sessions court to complete the hearing within ten days of assigning the case to a new bench.
