Wrestlers' harassment case: Hugging, touching without sexual intent is not offence, says Brij Bhushan's counsel

Wrestlers' harassment case: In the latest update on women wrestlers' harassment case, the counsel for BJP MP Brij Bhushan Sharan on Wednesday argued that hugging or touching a woman without sexual intent is not an offence.

The counsel also made a submission to Rouse Avenue Court on the issue of jurisdiction and limitations in the case. He stated that the allegations are time-barred.


Advocate Rajiv Mohan, attorney for Brij Bhushan Sharan Singh, presented his arguments before Additional Chief Metropolitan Magistrate (ACMM) Harjeet Singh Jaspal.

The case has been scheduled for further hearings on Thursday.

This case was registered on complaint by women wrestlers and Delhi police filed a charge sheet against Brij Bhushan Sharan Singh and Vinod Tomar.

According to Advocate Rajiv Mohan, the chargesheet was filed based on claims made by six wrestlers.

According to Section 218 of the CRPC, each offence requires a separate chargesheet, the counsel said.

He further objected to the court's jurisdiction over the matter in question. He argued that concerns about jurisdiction and limitation might be heard at the charge stage. "If we take these allegations, Indian jurisdiction only lies in three of these allegations."

Section 188 CrPC has an explicit bar. This court will not have jurisdiction over any claims or offences committed outside of India unless the necessary sanctions are imposed, according to Advocate Rajiv Mohan.

He argued that the Delhi court has jurisdiction in these cases.

CrPC determines the location of the investigation and trial. Unless there is a continuing offence, territorial jurisdiction inside India exists at the location of the incidents, he argued.

Meanwhile, he claimed that offences such as outraging modesty, rape, and murder are not considered continuous offences.
