Tarn Taran fake encounter: Life imprisonment for former SHO, five year jail term for constable

PTC News Desk: Mohali's CBI court has awarded life imprisonment for then Patti SHO Sita Ram and five year jail term for Constable Rajpal in 32 year old fake encounter case. 


Sita Ram was convicted under Sections 302, 201 and 218 of the IPC while Rajpal was convicted under Sections 201 and 120-B of the IPC.

Notably, 11 police officers were charged with kidnapping, illegal detention and murder however 4 of them died during the trial, whereas five police officials were acquitted by the court giving them benefit of doubt. 

The verdict has been pronounced 32 years after the fake encounter.

What is the fake encounter case ?

The CBI conducted investigation on the directives of the Supreme Court in 1955. The CBI conducted preliminary inquiry and recorded statement of Gian Singh on November 27, 1996. In February 1997, a regular case under sections 364 (kidnapping), 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code (IPC) was registered by the CBI at Jammu against Assistant Sub-Inspector (ASI) Norang Singh and others of Kairon police post and Patti police station.

The CBI's public prosecutor established that  on January 30, 1993, Gurdev Singh Deba, resident of Galalipur, Tarn Taran, was picked up from his residence by police party headed by ASI Norang Singh, in charge of police station Karon while on February 5, 1993 another youth Sukhwant Singh was picked up from his residence Bahmniwala village in Tarn Taran,  by team led by ASI Didar Singh of Patti police station, Tarn Taran. 

Later, both the youths were shows killed in an encounter on February 6, 1993 in Bhagupur area. Both the bodies were cremated citing 'unclaimed' and were not handed over to the family. At that time, police claimed that both the youths were involved in 300 cases of murder, extortion etc. However, the investigation conducted by CBI fount the claims to be incorrect. 

Following completion of investigation, CBI filed a charge sheet against 11 police officers.
