SC defers Haryana's appeal against HC stay on 75% job quota

New Delhi, February 7: The Supreme Court has deferred the Haryana Government's appeal against the Punjab and Haryana High Court’s stay on its 75 per cent quota for locals in the private sector until Friday. The Haryana Government’s law makes it mandatory for the private sector to reserve 75 per cent to locally domiciled people in private-sector jobs that offer a monthly salary of less than Rs 30,000 from January 15, 2022. Following this, the Haryana Government moved the Supreme Court challenging the HC's order. The petitioners argued that the law was against the provisions of the Constitution and went against the basic principle of meritocracy that acted as the foundation for businesses to grow and remain competitive. The Haryana State Employment of Local Candidates Act, 2020, was passed in November last year. It had come into effect on January 15 this year. It provides 75 per cent reservation for local youth in private sector jobs that offer a salary of less than 30,000 a month. It covered private companies, societies, trusts and partnership firms in Haryana, as per a notification issued by the state government. As per the notification issued by the Haryana Government on January 10, the Haryana State Employment of Local Candidates Act, 2020 requires local residents to carry the family identity card — the Parivar Pehchan Patra — for being eligible to register for employment on a designated portal of the Haryana Labour Department (https://local.hrylabour.gov.in/). The Haryana Assembly passed the legislation titled the Haryana State Employment of Local Candidates Bill on November 5, 2020, and the Governor gave his assent to the Bill on March 2 last year.
