H-1B Visa: Joe Biden administration proposes changes in H-1B foreign visa to improve efficiency

H-1B Visa: In order to increase the efficiency of streamlining eligibility, giving more flexibility to F-1 students, entrepreneurs, the Biden administration proposes some modifications in H-1B foreign worker programme Biden proposes new changes for efficient working of non-profit organisations, and assuring improved working conditions for other non-immigrant workers.

Without making any modifications in the Congress-mandated 60,000 cap on the number of such visas that the US issues each year, proposal have been made to change the rules which are set to be published in the Federal Register on October 23 by the US Citizenship and Immigration Services (USCIS).


The proposed rule amendments aim to simplify eligibility requirements, improve programme efficiency, provide additional benefits and flexibility to businesses, and strengthen integrity measures.

Notably, the H-1B programme supports US firms in hiring the people they require to satisfy their business objectives and remain competitive in the global marketplace, while complying to all US worker protection laws.

The proposal by Joe Biden would change the resignation and selection process of H-1B conducted by USCIS in order to reduce the possibility of misuse and fraud

Under the current existing system, the more registrations made on an individual's behalf, the more likely chances of the person to be selected as lottery. 

According to the revised proposal by Joe Biden administration, regardless of the number of registrations received on their behalf, each individual would be placed into the selection process just once.


The proposed modifications may significantly reduce and eliminates the benefit of filing multiple registrations for the same beneficiary just to increase the likelihood of selection, increasing the likelihood that a genuine registration will be selected. Thus the proposal will be beneficial for regular job aspirants also. 

Meanwhile, under the proposed rule, certain exemptions from the H-1B cap would be extended to certain nonprofit or government research organizations and to beneficiaries who are not directly employed by the eligible organization. 

Strengthening integrity measures and changing the selection process would reduce fraud and fraud in the H-1B registration process by prohibiting affiliates from filing multiple registrations for the same beneficiary.
