Delhi BMW crash: Accused driver Gaganpreet tells court 'DTC bus that collided with two-wheeler, ambulance also responsible'

PTC Web Desk:  The Delhi High Court on Wednesday heard the bail plea of Gaganpreet Kaur, the BMW driver involved in a fatal accident near Dhaula Kuan that claimed the life of Navjot Singh, a deputy secretary in the Department of Economic Affairs. Singh’s wife, who was riding pillion, sustained injuries in the crash.

Gaganpreet Kaur, arrested on Monday and remanded in judicial custody, argued before the court that the incident, while unfortunate, was part of the larger context of road accidents in India, with over 5,000 accidents reported annually. She also questioned the police for not taking action against other vehicles, including a DTC bus that collided with the two-wheeler and an ambulance reportedly present at the scene but failing to assist the victims.


Senior advocate Ramesh Gupta, appearing for her, raised concerns over the invocation of Section 105 of the Bharatiya Nyaya Sanhita (BNS), equivalent to Section 304 of the Indian Penal Code relating to culpable homicide not amounting to murder. Gupta argued that the appropriate sub-section should have been considered, which would allow the court discretion to grant bail.

“The incident is unfortunate, but thousands of accidents happen every year. The investigation should account for all contributing factors, including the involvement of the DTC bus and the ambulance that did not provide assistance,” Gupta told the court.

The Delhi High Court, after hearing the arguments, adjourned the bail hearing to Saturday. Meanwhile, the police continue their investigation into the crash to determine the sequence of events and liability.
