Tejashwi Yadav moves Delhi HC challenging CBI summons in land-for-jobs scam

New Delhi, March 15: Bihar Deputy Chief Minister Tejashwi Yadav moved the Delhi High Court, seeking the quashing of three summons issued by the Central Bureau of Investigation (CBI) in land-for-jobs scam case.

According to the plea, a notice under section 160 of the CrPC can only be issued to someone who lives within the local jurisdiction of that police station or the adjoining police station. As a result, the impugned notices were issued in blatant violation of the provisions of the CrPC, specifically Section 160 of the CrPC. On Thursday, the matter will be heard by Justice Dinesh Kumar Sharma's Bench.


The petitioner is also a permanent resident of Patna, Bihar, according to the plea.

The petitioner, on the other hand, has received the aforementioned Impugned Notices from the Respondent, which require him to appear in New Delhi. However, this is in violation of the law.

Tejashwi Yadav also requested that directions be issued to the CBI that whenever the Petitioner is interrogated in the current FIR, he be allowed the presence of his advocate(s) at a visible but not audible distance, in accordance with Supreme Court of India precedent.

He also stated that the petitioner (Tejashwi Yadav) is bound to cooperate and assist in the ongoing investigation.

Tejashwi Yadav also asked for a direction, specifically a mandamus, to quash summonses issued by the CBI on February 28, 2023, March 4, 2023, and March 11, 2023, for appearance before the CBI's New Delhi branch.
